End User License Agreement — RSV Rescue
Version: 1.0 · Effective date: 4 November 2026
This End User License Agreement ("Agreement") is between Aphex Coding, Bartłomiej Rakuzy Aphex Coding, Morska 139/6, 81-222 Gdynia, woj. pomorskie, Poland, tax ID (NIP) 8862855318 ("we", "us"), and you ("you"). If you accept this Agreement on behalf of a company or other organization, "you" means that organization, and you confirm that you are authorized to bind it.
By installing or using RSV Rescue you accept this Agreement. If you do not accept it, do not install or use the Software.
Important — what the Software can and cannot do
- Recovery is not guaranteed for every file. The Software rebuilds a playable video from the data the camera wrote to the card before the recording was interrupted. If that data is missing or damaged, it cannot be recovered.
- The last moments are lost. The last moments before the interruption (the last incomplete part of the recording) cannot be recovered. If the data is damaged further back, recovery stops at that point and the Software tells you so.
- Older cameras need a reference clip. Some older cameras do not store everything needed for the repair in the interrupted file. Then the Software needs a healthy video recorded with the same camera and the same settings. It looks for one on the card or in the folder; if it finds none that matches, it tells you and does not create a file.
- Try before you buy. The free scan and the 10-second preview show, on your own recording, whether it can be read. The preview shows the beginning of the recording only; it does not prove that every later part is intact.
- Your card is only read. The Software never changes your original files and does not save repaired files back to the card. Until you have checked the repaired videos, do not record on the card and do not format it.
1. Definitions
- Software — the RSV Rescue application for Windows (window and command-line programs), its updates and its documentation, excluding the third-party components described in section 10.
- Your Recordings — the interrupted recordings (.RSV files), the healthy video files used as reference clips, and the other files on the memory card or in the folder that you open with the Software.
- Output — the repaired video files, previews and scan results the Software creates from Your Recordings.
- Trial Mode — the Software used without an activated License Key.
- License — the paid right described in section 4, purchased for a one-time fee.
- License Key — the key you receive after buying a License.
- Licensed Computer — a computer on which the License Key is currently activated.
- Consumer — a natural person who accepts this Agreement for purposes outside their trade, business, craft or profession, and any other person whom the mandatory law of their country protects as a consumer in this Agreement (in Poland this includes a sole trader for whom the Agreement is not of a professional nature).
2. Free download and Trial Mode
The Software is offered free of charge. You may install it on any number of computers.
In Trial Mode you may scan memory cards and folders without limit and make previews: a preview shows up to the first 10 seconds of the repaired recording, reduced in size and with a "trial preview" watermark. Trial Mode does not save full repaired files. Trial Mode has no time limit, requires no registration and makes no internet connection. You may keep and use previews for any lawful purpose, but you may not edit them to remove the watermark.
3. Ownership
The Software is licensed, not sold. We and our licensors keep all rights, title and interest in the Software. You receive only the rights expressly granted in this Agreement. We do not own the third-party components described in section 10.
4. The paid License
Subject to this Agreement and to payment of the fee, we grant you a perpetual, non-exclusive, non-transferable license, without territorial limits, to use the Software to save full repaired files:
a) All files. There is no limit on the number of recordings, files or memory cards you repair, and no fee per file.
b) One Licensed Computer at a time. You may activate one License Key on one (1) computer at a time. You may move the License to another computer by deactivating it on the Licensed Computer (button Deactivate on this computer in the License window, or the command rsvrescue license deactivate) and activating it on the new one. If a Licensed Computer is lost or broken, write to us and we will release that activation.
c) Who may use it. The Software may be used on the Licensed Computer by you and the members of your household, and, if you are an organization, by your employees and contractors, for your own purposes, including professional work such as repairing recordings you made for your clients.
d) No subscription. The fee is paid once. There are no recurring charges.
5. Activation and license checks
Activating a License Key requires an internet connection once. After that the Software works offline. While a License is active, the Software re-checks it with the license server about every 14 days when a connection is available; a missing connection never disables the License. If the License has been refunded, cancelled or charged back, or is no longer activated on that computer, the Software returns to Trial Mode. The data sent during activation and checks is described in our Privacy Policy, included with the Software as PRIVACY.txt and available at https://rsv.aphexcoding.tech/privacy.
6. Purchase, reseller and refunds
a) Who sells the License. Licenses are sold by Freemius, Inc. (USA), our authorized reseller and merchant of record. Your purchase contract is with Freemius: Freemius issues the invoice, collects payment and any applicable sales tax or VAT, and the terms Freemius presents at checkout apply to the purchase and payment. The price is shown at checkout.
b) This Agreement and the Freemius terms. At checkout Freemius presents its own End User License Agreement (the "Freemius EULA"), under which Freemius is the seller. The Freemius EULA governs the purchase, payment, invoicing, refunds paid by Freemius and any dispute between you and Freemius. This Agreement governs the license to use the Software and any dispute between you and us. The number of Licensed Computers in section 4(b) is the volume limitation specified at checkout for the purposes of the Freemius EULA. Nothing in the Freemius EULA reduces the rights this Agreement gives you against us.
c) 14-day repair guarantee. If the Software does not work for you as described in this Agreement — for example it cannot save a playable repaired file from your recording, the saved file does not play, or the Software does not run on your computer — write to support@aphexcoding.tech or use the Freemius customer portal within 14 days of purchase. If we cannot solve the problem, you get a full refund of the amount you paid, including any tax charged at checkout. The refund is paid by Freemius. After a refund the License Key is cancelled and the Software returns to Trial Mode. If Freemius cancels a purchase and refunds it, the License ends and section 5 applies.
d) Consumers. If you are a Consumer, your statutory rights — including any right of withdrawal and your rights if the Software does not conform to the contract — are not affected by this Agreement. The guarantee in section 6(c) is given in addition to those rights.
7. Updates and support
a) We may provide updates. Your License Key works with all updates of the Software that we publish. We are not obliged to provide new features. If you are a Consumer, we will provide the updates, including security updates, that the law requires to keep the Software in conformity with the contract.
b) Support is provided by e-mail at support@aphexcoding.tech, in English or Polish, on a reasonable-efforts basis. There is no guaranteed response time, except that we answer complaints from Consumers within 14 days of receiving them. Please do not send us your video files; section 6 of our Privacy Policy explains what to send instead.
8. Restrictions
You must not:
a) change the Software's own program files in order to remove, bypass or disable the Trial Mode limits, the preview watermark or the license check, or help others do so;
b) share, publish, sell, rent or sublicense a License Key, or activate it on more computers than allowed;
c) remove copyright, trademark or license notices from the Software;
d) use the Software to break the law or to infringe the rights of others.
This section does not limit your rights under section 10, including your right to modify or replace the FFmpeg components, and does not limit what the law allows you to do with the Software regardless of this Agreement.
9. Your Recordings and the Output
a) Everything stays on your computer. The Software processes Your Recordings only on your computer. We do not receive, upload or see them.
b) Your originals are not changed. The Software only reads Your Recordings; it does not change, move or delete them, and it refuses to save repaired files to the memory card it is repairing from. It writes only: the repaired files, to the folder you choose, through a temporary file that is renamed when the file is complete and deleted if saving fails or is cancelled; previews and their temporary working files, which it deletes when the preview is finished or, for previews made in the program window, when you close the window; and its own license files in the app data folder (license.json and device.json, see our Privacy Policy).
c) No re-encoding. A repaired file contains the video and audio data as the camera recorded them, in a new container. The preview is re-encoded at a lower resolution and may show colors differently, especially for S-Log or HLG recordings; this does not affect the repaired file.
d) Your responsibility for the content. You are responsible for having the right to use Your Recordings — for example recordings of other people or of events you filmed for others — in the way you use the Output, and for complying with the law with regard to personal data of people shown in them. We are not a processor of that data.
e) The Output belongs to you, subject to the rights of others in Your Recordings. We claim no rights in it.
f) What to expect. The section "Important" at the beginning of this Agreement describes the limits of recovery. Check each repaired video before you rely on it, and keep the original card or a copy of it until you have done so.
10. Third-party components
a) The Software includes open-source components, each licensed under its own terms, which are listed with their license texts in the file THIRD-PARTY-NOTICES.txt and the "licenses" folder supplied with the Software. Nothing in this Agreement limits your rights under those licenses.
b) FFmpeg. The Software uses programs and libraries of the FFmpeg project (https://ffmpeg.org), supplied in the "ffmpeg" folder and licensed under the GNU Lesser General Public License, version 3 or later, to make previews. FFmpeg is not owned by us and is not covered by the license in section 4. You may modify those components, replace them with your own build, and reverse engineer the Software to the extent needed to debug such modifications. Where to get the corresponding source code is stated in THIRD-PARTY-NOTICES.txt and ffmpeg/BUILD-INFO.txt; you can also ask for it at support@aphexcoding.tech.
c) Where available, the Software uses video and audio encoders that are part of Windows (Media Foundation) for previews. They are not part of the Software and are governed by the Windows license terms.
11. Trademarks and independence
RSV Rescue is an independent product of Aphex Coding. It is not affiliated with, sponsored or endorsed by Sony. Sony, XAVC, XAVC S, XAVC S-I, XAVC HS and the names of Sony camera models are trademarks or registered trademarks of Sony Group Corporation or its affiliates; they are used only to describe the cameras and the files the Software reads. Windows is a trademark of the Microsoft group of companies. FFmpeg is a trademark of Fabrice Bellard. Other names are trademarks of their owners.
12. Freemius
This Agreement is between you and us only. Freemius, Inc. is not a party to this Agreement; its role is described in section 6.
13. Warranty
a) We will make reasonable efforts to keep the Software working as described in this Agreement and its documentation.
b) If you are not a Consumer: because the free scan and preview let you test the Software on your own recordings before buying, and section 6(c) gives you a repair guarantee, the Software is otherwise provided "as is", without other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.
c) If you are a Consumer, you keep all your statutory rights for digital content that does not conform to the contract; section 13(b) does not apply to you.
14. Limitation of liability
a) If you are not a Consumer, and to the extent permitted by law, we are not liable for indirect or consequential damages, lost profits, lost data or business interruption.
b) If you are not a Consumer, and to the extent permitted by law, our total liability under this Agreement is limited to the amount you paid for the License, or USD 10 if you use the Software only in Trial Mode.
c) If you are a Consumer, we are liable under the mandatory law of your country of residence, and sections 14(a) and 14(b) apply only to the extent that law allows.
d) Nothing in this Agreement limits liability for damage caused intentionally or by gross negligence, for death or personal injury, under product liability law (including for destroyed or corrupted data that you do not use for professional purposes), or any other liability that cannot be limited under applicable law.
15. Term and termination
This Agreement applies for as long as you use the Software. It ends automatically if you materially breach it and do not cure the breach within 14 days after our notice; then you must stop using the Software and the License Key is cancelled. We will not terminate a paid License for any other reason. Sections 3, 8, 9, 10, 12, 14, 16 and 17 survive termination.
16. Export and sanctions
You must comply with export control and sanctions laws that apply to you. You may not use the Software if you are located in, or are a resident of, a country or region subject to comprehensive EU or US sanctions, or are on a sanctions list.
17. Governing law and disputes
This Agreement and any dispute between you and us are governed by Polish law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are not a Consumer, disputes will be resolved by the court having jurisdiction over our registered place of business. If you are a Consumer, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings in the courts of your country of residence. This section does not apply to disputes between you and Freemius, which are governed by the Freemius EULA.
18. Changes to this Agreement
We may update this Agreement for new versions of the Software, for example to reflect new features or changes in the law. Changes do not reduce the rights you have already paid for under a License without your consent. The current version is available at https://rsv.aphexcoding.tech/eula, with its effective date.
19. Miscellaneous
If any provision is found unenforceable, the rest remains in effect. This Agreement, together with our Privacy Policy, is the entire agreement between you and us about the Software. This Agreement is available in English and in Polish (https://rsv.aphexcoding.tech/pl/eula). For Consumers in Poland the Polish version is binding; if the versions differ, the version more favourable to the Consumer applies. In all other cases the English version prevails.
